Altercation at Keystone Results in Summons for Disorderly Conduct

Two parties at Keystone recently received a criminal summons for an altercation on the mountain. The female uphill skier noticed the snowboarder, who was downhill from her, making turns that the skier deemed to be too wide while carving down the mountain. Believing the snowboarder’s turning has nearly caused many collisions, including one with herself, she and her husband flagged down the snowboarder. A fight quickly ensued.

The snowboarder explained he believed he had the right of way because he was downhill. The skier’s husband disagreed, and he and the snowboarder engaged in a short scuffle on the ground before separating. Though no injuries occurred, both parties received court summons for disorderly conduct.

The snowboarder was correct pursuant to the Colorado Skier Safety Act because he was downhill of the skier. The uphill skier has the duty to maintain a proper lookout to avoid collisions with skiers and snowboarder below.
